Introduction

This privacy policy is for ViewSonic Account and is intended to inform users of the use of their personal information and their privacy rights on the ViewSonic Account.

Please note that references to the EU General Data Protection Regulation (GDPR) in the jurisdiction of the United Kingdom (UK) are instead references to the United Kingdom General Data Protection Regulation (UK GDPR). The UK GDPR and the EU GDPR contain similar rules, but apply to EU and the UK respectively.

Your Data Subject Rights

You can exercise the following rights at any time using the contact details provided by our data protection officer:

  • Correction of incorrect personal data (Art. 16 GDPR),
  • Deletion of your data stored by us (Art. 17 GDPR),
  • Restriction of data processing if we are not yet allowed to delete your data due to legal obligations (Art. 18 GDPR),
  • objection to the processing of your data by us (Art. 21 GDPR) and
  • Data portability, insofar as you have consented to the data processing or have concluded a contract with us (Art. 20 GDPR).
  • If you have given us consent, you can revoke it at any time with effect for the future.

Should the applicable laws on the protection of personal data and the privacy of the individual user in your relevant jurisdiction grant you further rights these shall naturally be followed as well.

You may at any time lodge a complaint with a supervisory authority, e.g. the competent supervisory authority in the federal state, province, or country of your residence or the authority responsible for us as the controller.


Collection of General Information

Nature and purpose of processing:When you access our ViewSonic Account, i.e., when you do not register or otherwise submit information, information of a general nature is automatically collected. This information (so called “server log files”) includes, for example, the type of web browser, the operating system used, the domain name of your Internet service provider, your IP address and the like.

In particular, they are processed for the following purposes:

  • To ensure a smooth connection setup of the ecosystem,
  • To ensure a smooth use of our ecosystem,
  • To ensure a smooth use of ViewSonic products,
  • To evaluate system security and stability, and
  • To optimize our ecosystem.

We do not use your data to draw conclusions about you personally. Information of this kind is statistically evaluated by us anonymously, if necessary, in order to optimize our website and the technology behind it.

Legal basis:The processing is carried out in accordance with Art. 6 (1) (f) GDPR on the basis of our legitimate interest in improving the stability and functionality of our website.

Recipients:Recipients of the data may be technical service providers who act as data processors for the operation and maintenance of our website.

Third country transfer:The collected data may be transferred to the following third countries:

Storage period:Data is deleted as soon as it is no longer required for the purpose for which it was collected. For data used to provide the website, this is generally the case when the respective session has ended.

In the case of storage of data in log files, this is the case after 45 days at the latest. Storage beyond this period is possible. In this case, the IP addresses of the users are anonymized, so that an assignment of the calling client is no longer possible.

Provision prescribed or required:The provision of the aforementioned personal data is neither legally nor contractually required. However, without the IP address, the service and functionality of our website is not guaranteed. In addition, individual services and services may not be available or may be limited.

Registration of a ViewSonic Account

Nature and purpose of processing:When you create an account for ViewSonic Account, the following data is processed:

  • First and last name
  • E-mail address
  • A checksum of the password you have chosen
  • The time of your registration as well as the last change of your user data
  • Logging of accesses
  • Logging of failed login attempts and system errors
  • Notifications received, as well as information about which notification has already been seen/clicked on

This data is used to log you into your account, maintain your account, communicate with you, bill you, allow you to use ViewSonic other systems, uphold our contractual obligations and if you have consented thereto, provide you with monthly reports, newsletters and similar material.

Depending on whether you have chosen a subscription or not, we may be subject to various legal obligations regarding your subscription that entail data processing. These include, for example, requirements under tax laws and statutory accounting, the fulfillment of requests by external parties, e.g. the requirements of supervisory or law enforcement authorities, as well as the fulfillment of tax control and reporting obligations.

Legal basis:The legal basis for the processing is either your consent to the processing, or the processing is necessary for the conclusion and maintenance of a contract.

Recipients:Recipients of the data are, if applicable, technical service providers who act as data processors for the operation and maintenance of ViewSonic Account and your account and subscription.

Depending on which payment method you select in the ordering process, we pass on the payment data collected for this purpose to the credit institution commissioned with the payment and, if applicable, to payment service providers commissioned by us or to the payment service selected by you in the ordering process.

Other recipients of your personal data are, for example, public bodies and institutions (e.g. tax authorities, law enforcement agencies) in the event of a legal or official obligation, tax advisors, business and payroll tax auditors (legal audit mandate).

Storage period:Your organisation, as the data controller, is responsible for implementing all deletion deadlines. If you wish to delete your account, because you have withdrawn your consent to the processing, please use the “delete my account” option.

Provision prescribed or required:The data collected on the basis of your consent is deleted as soon as it is no longer required for the purpose for which it was collected or you have withdrawn your consent. Should your account be inactive for a period of 3 years, we will delete the account and all related personal information, as it is deemed to be no longer required for the purpose for which it was collected. Alternatively, if you wish to delete your account, please use the “delete my account” option.

We store data processed on the basis of a contract in our systems until the statutory retention periods have expired. These are generally 6 or 10 years for reasons of proper accounting and tax law requirements.


Single-Sign-On

We also enable Single-Sign-On Logins to allow you to log in via other online access data for an easier and more comfortable access to your online products. Of course, you can also register an account by creating your own login.

We provide the following Single-Sign-On methods:

  • Taiwan MOE (only available in Taiwan)
  • Facebook

When using Single-Sign-On options, the following data is processed, and may be transferred to the service providers above:

  • First and last name
  • Respective e-mail address
  • In case of Taiwan MOE additional school ID

The legal basis is your consent in accordance with Art. 6 para. 1 lit. a) GDPR (within EU). You can withdraw your consent any time for the future. You would then need to create a new account based on new information via Single-Sign-On or our registration process to further use our products. We store your data as long as your consent is given.

The provision of your data is neither legally nor contractually required. It is possible to generate your own ViewSonic account in order to use our products.

Information about your right of objection according to Art. 21 GDPR

Individual right of objectionYou have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data relating to you which is carried out on the basis of Art. 6(1)(f) GDPR (data processing on the basis of a balance of interests); this also applies to profiling based on this provision within the meaning of Art. 4 No. 4 GDPR.

If you object, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the purpose of asserting, exercising or defending legal claims.

We reserve the right to adapt this data protection declaration so that it always complies with the current legal requirements or in order to implement changes to our services in the data protection declaration, e.g. when introducing new services.
